Terms of Use — Bikote
1. Acceptance of These Terms
By creating an account or using Bikote (the "Service"), operated by Yohz Ventures Sdn Bhd ("we", "us"), you agree to these Terms of Use. If you do not agree, do not use the Service. You must be at least 18 years old to use the Service.
2. What the Service Is — and Is Not
The Service is an introduction platform. It suggests potential doubles partners in the racquet and paddle sports the Service supports (at launch: pickleball, padel, and tennis) based on skill assessments, questionnaire responses, and preferences, and provides tools for users to communicate.
The Service is not:
- an organizer, host, supervisor, or sponsor of any game, practice, or tournament;
- a coach, trainer, or provider of athletic instruction;
- a provider of medical, psychological, or counseling services;
- a guarantor of any person's skill, character, conduct, fitness, or identity.
We do not conduct background checks, identity verification, or medical screening on any user. All meetings, games, and activities arranged through the Service occur entirely at your own initiative and risk.
3. Assumption of Risk — Physical Activity
Pickleball, padel, and tennis are physical sports. Participation carries inherent risks including, without limitation: falls, collisions, being struck by a ball, paddle, or racquet, impact with court walls or fixtures, muscle and joint injuries, cardiac events, heat-related illness, property damage, and, in rare cases, permanent disability or death.
By using the Service to find partners or opponents, you knowingly and voluntarily assume all risks associated with playing any sport the Service supports and with meeting and interacting with other users, whether on or off the court. You are solely responsible for:
- assessing your own health and fitness to play, and consulting a physician where appropriate;
- inspecting the safety of any venue, court, and equipment you use;
- deciding whether, where, when, and with whom to play.
4. Interactions With Other Users
You are solely responsible for your interactions with other users. We are not responsible for the conduct of any user, on or off the Service, online or in person. Exercise caution appropriate to meeting a stranger: meet in public venues, tell someone where you are going, and stop any interaction that makes you uncomfortable.
Disputes between users (including disputes about partnerships, match arrangements, costs, or conduct) are solely between the users involved. You release us from all claims arising out of or connected with any dispute with another user.
5. Ratings, Assessments, and Match Suggestions
Skill profiles on the Service are derived from subjective assessments submitted by other users (including people you invite) and from information users enter themselves (including self-assessed skill ratings). Match suggestions, compatibility scores, and generated descriptions are estimates and opinions produced by automated processes for entertainment and convenience.
We do not warrant that any rating, score, compatibility indication, or generated text is accurate, complete, or current, or that any suggested pairing will be successful, safe, enjoyable, or suitable for you. A match suggestion is not a recommendation that you meet or play with any person. You alone decide whom to contact and whom to play with.
You agree not to bring any claim based on the content of a skill assessment, compatibility score, match suggestion, or generated description, including claims relating to disappointment, hurt feelings, reputational concern, or the outcome of any partnership or match.
6. No Medical or Emotional Support Services
The Service's questionnaires and descriptions may touch on temperament, communication style, and responses to pressure. These are used solely for pairing convenience. They are not psychological assessment, diagnosis, therapy, or advice, and must not be relied on as such.
7. User Conduct
You agree not to: submit assessments you know to be false or malicious; harass, threaten, stalk, or harm any user; use the Service to contact individuals for purposes unrelated to the sports it supports; send unsolicited communications, friend requests, or partner invitations at a volume or frequency that constitutes spam; misrepresent your identity, skill, or rating; attempt to circumvent rate limits, quota systems, or other technical protections; or use the Service while under any legal restriction that makes contact with other users unlawful.
We have zero tolerance for objectionable content and abusive users. You must not submit, post, transmit, or share any content that is offensive, abusive, harassing, threatening, defamatory, obscene, pornographic, hateful, or that targets any person or group — and you must not behave abusively, harass, or prey on any user. To keep the Service safe, you can report objectionable content or an abusive user, or block that user, directly from their profile at any time; blocking a user immediately removes them from your experience. Content reported as objectionable, and users reported as abusive, are reviewed and acted on within 24 hours — the offending content is removed and the user responsible is ejected from the Service.
We may suspend or terminate accounts that violate these rules. Some protections are enforced automatically: accounts that trigger our abuse-detection thresholds — including but not limited to excessive rejected friend requests or partner invitations, sustained rate-limit violations, or scripted access patterns — may be suspended without prior notice. Suspended users can contact support to request review. We assume no duty to any user to monitor, police, or intervene in user conduct.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
(a) WE SHALL NOT BE LIABLE FOR ANY PERSONAL INJURY, DEATH, PROPERTY DAMAGE, OR EMOTIONAL OR PSYCHOLOGICAL HARM ARISING OUT OF OR IN CONNECTION WITH (i) ANY GAME, PRACTICE, TOURNAMENT, OR OTHER ACTIVITY ARRANGED THROUGH OR FACILITATED BY THE SERVICE, (ii) ANY MEETING OR INTERACTION WITH ANY USER, OR (iii) ANY MATCH SUGGESTION, RATING, SCORE, OR GENERATED CONTENT;
(b) WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL;
(c) OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (i) THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE AND (ii) RM 500.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including, where applicable, liability for death or personal injury caused by our own negligence, or for fraud. In jurisdictions that do not allow certain exclusions, those exclusions apply only to the extent permitted.
10. Release
To the maximum extent permitted by applicable law, you release Yohz Ventures Sdn Bhd, its officers, directors, employees, and agents from all claims, demands, and damages of every kind, known and unknown, arising out of or in any way connected with (a) your participation in any sport or related activity with users you met through the Service, and (b) disputes with other users.
11. Indemnification
You agree to indemnify and hold harmless Yohz Ventures Sdn Bhd from claims brought by third parties (including other users) arising out of your use of the Service, your conduct at any activity arranged through the Service, your violation of these Terms, or your violation of any law or the rights of any person.
12. Assessments You Submit About Others
When you assess another user's skills, you represent that your assessment reflects your honest opinion based on personal observation. Assessments are subjective opinions, are presented to other users only in aggregated form, and are provided by you voluntarily. We are not liable for any user's reaction to aggregated assessments, and you agree we may use, aggregate, and display your assessment inputs within the Service.
13. Third-Party Services and Venues
The Service relies on third-party services (such as sign-in providers, payment/subscription processors, and hosting and messaging infrastructure) and users may arrange to play at third-party venues. We are not responsible for third-party services, their data, or the condition, safety, or management of any venue.
14. Suspension and Termination
We may suspend or terminate your access at any time for violation of these Terms or to protect users or the Service. You may stop using the Service and request account deletion at any time. Sections 3–5 and 8–12 survive termination.
15. Changes to the Service or Terms
We may modify the Service or these Terms. Material changes will be notified in-app or by email; continued use after notice constitutes acceptance.
16. Governing Law and Disputes
These Terms are governed by the laws of Malaysia, without regard to conflict-of-laws rules. Disputes shall be resolved in the courts of Kuala Lumpur, Malaysia.
